WEST CARROLLTON CITY COUNCIL REGULAR MEETING
Held May 12, 1998
PRESENT: Mayor Maxine Gilman; Council Members Bill Ennis, William Gordon, Jack Jensen, Linda Lotspaih and Jeff Sanner; City Manager Tracy Williams; Law Director Patrick Carney; Service Director Don Hill; Police Chief Don Rice; Planning and Economic Development Director David Humphreys; and Assistant Clerk of Council Patricia Replogle.
The meeting was called to order by Mayor Gilman. Pastor Mark Scroggins of First Baptist Church gave the invocation. The Pledge of Allegiance and Roll Call followed.
MINUTES
A motion was made by Mr. Sanner to approve the minutes of the Regular Council Meeting of April 28, 1998. Mrs. Lotspaih seconded the motion. A roll call vote was taken. All members voted Yes and the motion carried.
A motion was made by Mr. Gordon, seconded by Mr. Jensen, to approve the minutes of the Vision Retreat Meeting of April 30, 1998. With the exception of Mr. Sanner who abstained, all members voted Yes to a roll call vote and the motion carried.
PUBLIC HEARINGS
There were no Public Hearings.
COMMUNICATIONS AND PRESENTATIONS
Certificates of Achievement - West Carrollton Citizens Academy Graduates
Certificates were presented to graduates of the West Carrollton Citizen Academy by Mayor Gilman. Graduates were required to attend seven of the eight Citizens Academy meetings. Those receiving certificates were Rick Dobson, Linda Lotspaih, Leon Harrison and Ray Snider. All were present to receive their certificates except Mr. Dobson. Congratulations and appreciation were expressed by the Mayor.
Resolution No. 13-98: 1998 High School Valedictorians and Salutatorian
Mayor Gilman presented the resolution to each of the valedictorians and salutatorian. Mayor Gilman expressed appreciation of their achievements and said that not only do they represent their school but also represent the city of West Carrollton.
National Police Week / Peace Officers Memorial Day
Mayor Gilman read a Proclamation proclaiming May 11-15, 1998 as National Police Week and May 15, 1998 as Peace Officers Memorial Day. The Mayor noted that flags will be flown at half-mast on May 15th, and that a moving service was held at the First Church of God in Miamisburg last Sunday, which many area Chiefs and others attended. She then presented the Proclamation to Police Chief Rice and asked him to convey everyones appreciation to the department for all that they do for us each and every day. Chief Rice thanked the members of the Church for the fine service on Sunday and Council and the community for their support.
Public Service Recognition Week
A Proclamation was read by Mayor Gilman proclaiming May 17-23, 1998 as Public Service Recognition Week, She presented the Proclamation to City Manager Tracy Williams and asked him to convey to his staff everyones appreciation of all the work that they do for us. Mr. Williams thanked Council and stated that it is our pleasure to serve the public.
COMMENTS BY THE AUDIENCE
John Horn of Primrose Drive addressed Council regarding the flooding in his neighborhood. He stated that no one had contacted him or his neighbors yet although he did notice that the City employees had cleaned out the bridge. Mr. Horn said that although some work has been done, there is more to be done. He submitted a list of neighbors signatures who are requesting that work be done to prevent the flooding from occurring in their neighborhood again. Mayor Gilman said that Mr. Williams was to present a report during the Reports by Officers segment of the agenda but requested that Mr. Williams present his report at this time. Mr. Williams said that he had walked the Primrose tributary recently. Letters will be sent to residents reminding them that it is illegal to dump trash in the creek. Mr. Williams noted that in 1990 a study was completed which indicated that it would cost $1.7 million to complete any substantial changes to the Primrose Creek area. A review of the 1964 plans for that area indicated that all homes were to be constructed on slabs per protective covenants, although some of them were not. Mr. Williams indicated that they are still in a fact-finding mode and will need more time to research for major solutions, although a few small changes will be made, such as having several trees removed and having the Miami Conservancy dredge the creek. Mr. Williams noted that although dredging helps, the channel under Primrose bridge is not adequate. He intends to seek outside experts to help resolve this issue. It is a complex problem, and he hopes to know more in several weeks. Mr. Williams said that he values the citizens input and will keep in contact. Mr. Williams noted that the storm water utility concept is not yet allowed by the State. Mr. Horne suggested that a man-hole cover with a larger pipe be put in the middle of the street. Mr. Williams said that an engineer would need to determine if that is feasible and would solve some of the problem. He will look into other outlets for the water flow.
Mr. Horn said that the City may use his property to help find a solution and thanked Council for their time. Mayor Gilman suggested that our State representatives be contacted to see about reviving the storm water utility concept.

NEW BUSINESS
Ordinance No. 3092: Amendment to Zoning Code
Ordinance No. 3092: An ordinance amending Chapter 154 of the Code of Ordinances of West Carrollton known as the "Zoning Code", amending Section 154.04 to establish zoning definitions for automobile wrecking, junk, junk yard, and manufacturing categories.
Mr. Humphreys addressed Council noting that the public should know that this is a zoning public hearing. Mayor Gilman so advised that this would be a public hearing. Mr. Jensen asked if we need to advertise the public hearing. Mr. Humphreys said that we are required to advertise and that has been done. Mr. Sanner noted that this Ordinance is not on the agenda as a public hearing. Mr. Humphreys said that everything has been done according to the law. Mr. Jensen suggested that this Ordinance be put on the next agenda as a public hearing. It was decided that it would be on the next agenda.
Resolution No. 14-98: Daryl G. Garrison
Resolution No. 14-98: A resolution acknowledging the special appreciation of the citizens and public officials of the City of West Carrollton for services rendered unto said City by former Councilmember Daryl G. Garrison.
Mr. Jensen introduced and made a motion to approve Resolution No. 14-98. Mr. Gordon seconded the motion. A unanimous roll call vote carried the motion.

Since Mr. Williams had given his report earlier in the meeting, there were no other reports by officers.

COMMENTS BY COUNCIL
Mr. Gordon reminded everyone that the Paper Festival and Boat Show will be June 12-14, 1998 with the parade being held at 10 a.m. on Saturday, June 13th. The golf outing will be on June 17th.
Mr. Jensen and Mr. Sanner both commended the recipients of the various presentations and awards. Mr. Sanner also noted that the "Garage Sale Saturday" appears to have been successful.
Mayor Gilman thanked Ron Ziemkowski on cameras. She noted that the City Beautiful flower planting will be on May 15th, and that pool passes are now on sale at the Civic Center with the pool opening at noon on May 23rd. The Mayor noted that the Council vacancy will be in the newspapers, and that resumes with cover letters must be submitted by May 18th at 5 p.m. Mayor Gilman also thanked the students in the audience for attending the meeting.
A motion was made by Mayor Gilman, seconded by Mr. Gordon, to recess to a work session to discuss the items on the agenda.
Council recessed.
WORK SESSION
Joining City Council in the work session were City Manager, Tracy Williams; Service Director, Don Hill; and David Humphreys, Planning and Economic Development Director.
OWL CREEK
City Manager Williams and Service Director Don Hill noted that consultants and public agencies have studied the flooding concerns on Owl Creek and the Primrose tributary over the years, and determined that there was no financially feasible way to provide flood protection. However, they suggested that it might be worthwhile to have another consultant review the work that has been done previously to determine whether or not actions could be taken to help reduce the frequency of flooding. City Council concurred, and authorized the City staff to retain the services of a consultant with expertise in this area to determine if improvements could be made to reduce the risk of flooding.
1998 CITY COUNCIL VISION STATEMENT
City Council reviewed the draft Vision Statement prepared by Dr. Mary Ellen Mazey from Wright State University and requested that a couple minor revisions be made.
HOLES CREEK
City Manager Williams noted that the Corps of Engineers and the Norfolk-Southern Railroad, which is purchasing the Conrail system, had resolved some conflicts they had regarding the replacement of the bridge over Holes Creek, and that the Corps of Engineers was proceeding to take bids for Phase II for this project. Phase II involves the construction of the flood control improvements on Holes Creek from the railroad bridge upstream to near Lamme Road, including the replacement of the railroad bridge. Williams also noted that Norfolk-Southern set forth a requirement that the bridge be replaced within a 24 hour period, and that it be done on a holiday.
MAYROSE BRIDGE REPAIRS
City Manager Williams stated that the City had received only one bid for the repairs to the Mayrose bridge. Information concerning this matter was distributed to City Council, and City Council authorized the awarding of this contract following review of the staff report from Service Director Don Hill.
D.A.R.E. VAN
City Manager Williams distributed a request from Police Chief Don Rice to have a new D.A.R.E. logo painted on the new van, which was contributed by the Ronald McDonald charities. The cost for this work was estimated at approximately $750.00 and would be taken from the Enforcement and Education Fund. City Council authorized this work to be done, and the money to be taken from the Enforcement and Education Fund.
1998 BUDGET
Mayor Gilman requested that City Council consider releasing some of the 1998 expenditures, which were put on hold in conjunction with the 1998 Budget. Specifically, she requested that funds for education and a new car for the City Manager be released. Following discussion on this matter, City Council agreed to release the funds which had been put on hold for education, and also the funds which were put on hold for the acquisition of a new staff car for the City Manager.
MAYORS COMMENTS
Mayor Gilman noted that the City of Dayton was hosting a Town Hall meeting concerning urban sprawl on May 13, and distributed a brochure concerning this matter for Council to look at. She also requested that a sign-up sheet be distributed among the City Council for
Council members to serve at the Citys booth in conjunction with the 1998 West Carrollton Paper Festival and Boat Show. Mayor Gilman also requested that City Council members submit questions which they would like to have asked during the interviews for the applicants who have applied to fill the unexpired term of former Councilmember Daryl Garrison. Mayor Gilman noted that she would not be able to attend the Business Advisory Council meeting scheduled for May 13, and invited any member of Council to take her place if they could arrange their schedule to do so. Mayor Gilman and City Council set the dates and times for interviewing the candidates for the vacant councilmember position.
DARYL GARRISON
City Council requested that arrangements be made to hold a public Open House at the West Carrollton Senior Citizens/Community Center for former Councilmember Daryl Garrison. Discussion was also held concerning the possibility of having a dinner for the Garrisons, and they requested that the City Manager contact the Garrisons to discuss these arrangements.
BUSINESS OF THE YEAR AWARDS
Mayor Gilman stated that she had received information from the South Metro Chamber of Commerce requesting nominations for their annual Business of the Year Awards. After discussion on this matter, the City Council directed the City Manager to prepare nominations for: Fraser Papers; Red Rock Steakhouse and Saloon; and Williams Law Office.
ADJOURNMENT
Having no further business, Councilmember Jeff Sanner moved to adjourn. Councilmember Linda Lotspaih seconded the motion. All members present voting Yes, the motion carried. The meeting was adjourned at 9:25 p.m.
