West Carrollton City Council Meeting

December 14, 1999

 

PRESENT: Mayor Maxine Gilman; Council Members Bill Ennis; William Gordon; Jack Jensen, Linda Lotspaih and Donald Mounce; City Manager G. Tracy Williams; Assistant City Manager David Watson; Law Director Patrick Carney and Assistant Clerk of Council Patricia Replogle.

EXCUSED: Councilmember Jeff Sanner.

The meeting was called to order by Mayor Gilman. Joel Getts, Deacon with New Hope Community Church, gave the invocation. The pledge of allegiance followed.

MINUTES

A motion was made by Mr. Gordon, seconded by Mr. Ennis, to approve the minutes of the Regular Council Meeting of November 23, 1999. A roll call vote was taken, all members present voted yes and the motion carried.

Mayor Gilman expressed sympathy to Pastor Thomas Sager and family upon a death in their family.

PUBLIC HEARINGS

There were no Public Hearings.

There were no Communications or Presentations.

NEW BUSINESS

ANNUAL CONTRACT FOR LAW DIRECTOR SERVICES

Mayor Gilman noted that the contract is the same except for an increase in the per hour charge. Mr. Jensen asked if the contract had been reviewed by legal counsel. Mr. Williams said that the contract is the same as in prior years, with the exception of the fee amounts, and the original contract had been reviewed at that time.

A motion was made by Mr. Gordon, seconded by Mr. Mounce, to authorize the City Manager to enter into an agreement for Law Director services provided by Patrick G. Carney. All members present voted yes to a roll call vote and the motion carried.

MEMBERSHIP DUES FOR THE OHIO MUNICIPAL ATTORNEYS ASSN.

Mr. Carney requested that the City pay for the annual membership dues in the Ohio Municipal Attorneys Association. Mr. Jensen said he felt that was a part of the attorney's expenses. Mayor Gilman asked if Mr. Carney had been a member in the past. Mr. Carney responded that he had been a member and had paid for the dues but the cost of membership had increased dramatically. He also noted that the membership is not for him specifically but for whoever is the Law Director for the City. In response to a question from Mr. Jensen, Mr. Carney said that the Association provides updates during the year of any items of interest to municipalities.

Mr. Mounce made a motion, seconded by Mrs. Lotspaih, to authorize the payment of the membership dues to the Ohio Municipal Attorneys Association. A roll call vote was taken: Mayor Gilman-yes; Mr. Ennis-yes; Mr. Gordon-yes; Mr. Jensen-no; Mrs. Lotspaih-yes; Mr. Mounce-yes. The motion carried.

PAYMENT BY WEST CARROLLTON CITY SCHOOL DISTRICT FOR LEGAL

SERVICES RENDERED BY THE CITY LAW DIRECTOR

Mayor Gilman noted that the services were not used in 1998 and only $80. was billed in 1999.

Mr. Jensen made a motion, seconded by Mr. Ennis, to authorize the City Manager to enter into an agreement for payment by the West Carrollton City School District for legal services rendered by the City Law Director. All members voted yes and the motion carried.

 

REPRESENTATIVES - VOLUNTEER FIREFIGHTER DEPENDENTS FUND BOARD

A motion was made by Mr. Ennis, seconded by Mr. Gordon, to appoint Mr. Jensen and Mr. Mounce as Council representatives to the Volunteer Firefighter Dependents Fund Board for 2000. A unanimous roll call vote carried the motion.

2000 CONTRACT WITH THE MONTGOMERY COUNTY PUBLIC DEFENDER

Mayor Gilman noted that this service is required by law. Mr. Williams said that the cost is approximately $2,000 of which the City does receive some reimbursement. Mr. Carney added that the use of the Public Defender services has gone up by about 50% but the reimbursement from the State must have gone up also.

Mr. Jensen made a motion, seconded by Mr. Mounce, to authorize the City Manager to enter into an agreement with the Office of the Montgomery County Public Defender for the year 2000. All members present voted yes to a roll call vote and the motion carried.

ANIMAL CONTROL SERVICES FOR THE YEAR 2000

Mayor Gilman noted that the cost of the animal control officer will be shared jointly by the City of Miamisburg with 60% of the cost, and the City of West Carrollton with the remaining 40% of the cost. Mr. Carney said he has reviewed the contract and it is in order.

Mr. Mounce made a motion, seconded by Mrs. Lotspaih, to authorize the City Manager to renew the agreement with the City of Miamisburg for providing animal control services.

REPORTS BY OFFICERS

Mr. Williams noted that the sidewalk and curb assessments have been completed and will be available at the City Clerk's office. In addition, legal notice will be published three times in the newspaper and letters will be sent to each property owner. He noted that he will come back to Council at a later date for an ordinance on the assessments. He also wished everyone a merry Christmas.

Mayor Gilman noted that there were several students in the audience. She thanked them for coming.

COMMENTS BY COUNCIL

Mr. Ennis wished everyone a safe and merry Christmas and reminded them to be careful with candles especially during the holiday season. He also encouraged the students in the audience to come back again.

Mr. Jensen complimented the residents on their holiday decorations and wished everyone a merry Christmas.

Mrs. Lotspaih wished everyone a safe and happy holiday.

Mr. Mounce welcomed the students. He thanked everyone who participated in the Historical Tour. He also wished everyone a safe and happy holiday.

Mr. Gordon wished everyone a safe and happy holiday also.

Mayor Gilman read a list of those recognized by the City Beautiful Commission for their 1999 Holiday Decoration Awards. The Mayor thanked Ron Ziemkowski on cameras. She also wished the best to Mr. Sanner who is recuperating from hip replacement surgery. The Mayor also sent best wishes to Erma and Dorothy who are also recuperating. She wished a merry Christmas and happy holidays to everyone. The Mayor also sent a special wish to her granddaughter, Elizabeth.

ADJOURNMENT

Mayor Gilman made a motion, seconded by Mr. Gordon, to adjourn the meeting. All members present voted yes and the motion carried.
