West Carrollton City Council Meeting
February 10, 1998
PRESENT: Mayor Maxine Gilman; Council members Bill Ennis, Daryl Garrison, William
Gordon, Jack Jensen, Linda Lotspaih and Jeff Sanner; City Manager Tracy Williams;
Assistant City Manager David W. Rowlands; Law Director Patrick Carney; Service
Director Don Hill; Fire Chief Jack Keister; Director of Planning and Economic
Development David Humphreys; Parks and Recreation Director Rick Bolton; and
Assistant Clerk of Council Patricia Replogle.
The meeting was called to order by Mayor Gilman. Jim Robertson of Abundant Life
Baptist Church gave the invocation. The Pledge of Allegiance and Roll Call followed.
A motion was made by Mr. Jensen to approve the minutes of the Joint Meeting of City
Council with the Board of Zoning Appeals and Planning Commission on January 8, 1998.
Mr. Sanner seconded the motion. A roll call vote was taken; Mr. Ennis abstained, all
other members voted yes and the motion carried.
Mr. Garrison made a motion, seconded by Mrs. Lotspaih, to approve the minutes of the Regular Meeting of January 27, 1998. A unanimous roll call vote carried the motion.
Ordinance No. 3082: An ordinance amending Chapter 154 of the Code of Ordinances of
West Carrollton known as the "Zoning Code", amending Sections 154.01, 154.26-2,
154.36, 154.184, and adding Section 154.185 to provide enhanced landscape
regulations for the City.
Dave Humphreys gave a staff report and slide presentation to Council. He stated that in 1996 the Urban Design Plan was prepared and it recommended increased landscaping to enhance the visual appeal in the City by establishing business overlay districts and adopting general landscape requirements. Ordinance No. 3082 provides regulations designed to establish screening and buffering requirements which would enhance property values, protect citizens' safety and increase visual appeal. The Planning Commission recommends that landscaping be completed by a landscape architect except for single and two family lots, that landscaping be brought up to code in existing areas when there are changes in the zoning use of the property and simplify the language of the requirements. Mr. Humphreys presented several slides of areas in
West Carrollton and other cities that have undergone landscaping changes.
Mr. Garrison asked if the new regulations allowed for six foot solid wall fence or earth
mounds. He thought that the Ordinance did not allow solid fencing. Mr. Humphreys
responded that solid fencing is allowed if it is visually opaque but it is not allowed in front
yards.
This is the First Reading of Ordinance No. 3082.
Resolution No. 8-98: A resolution acknowledging the appreciation of the citizens and
public officials of the City of West Carrollton for services to the West Carrollton School
District by Jack McNabb.
Mayor Gilman read the resolution and presented it to Mr. McNabb. The Mayor noted that
Mr. McNabb has given 40 years of service to the schools and the youth of this City and
commended him on his dedication. Mr. McNabb thanked Council and said that the 40
years have gone by quickly. He cited a couple of incidents over the years.
Mr. Gordon commented on the fire drills at the schools he was involved in when he was
on the Fire Department. He said that Mr. McNabb has been a friend for many years and
he will be missed in the school district. He wished him good luck. Mr. Ennis, Mr. Jensen,
Mr. Garrison, Mrs. Lotspaih and Mr. Sanner all thanked Mr. McNabb for his forty years of
service to the schools and wished him luck in his retirement.
There were no comments by the audience.
Ord. No 3080: Change Churches & Private Schools to Conditionally Permitted Uses
Ordinance No. 3080: An ordinance amending Chapter 154 of the Code of Ordinances of
West Carrollton known as the "Zoning Code", amending Sections 154.89, 154.90,
154.100, 154.101, 154.110, 154.111, 154.120, 154.121, 154.130, 154.131, 154.140,
154.141, 154.150, 154.151, 154.181(C)(1) and 154.181(C)(2) to change churches and
private schools in residential districts from principally permitted uses to conditionally
permitted uses.
A motion was made by Mr. Ennis and seconded by Mr. Garrison to adopt Ordinance No. 3080. A roll call vote was taken. All members voted No and the motion failed.
Ordinance No. 3085: An ordinance establishing charges for Emergency Ambulance
Services provided by the City of West Carrollton, and establishing collection policies
regarding said charges.
Chief Keister presented a brief staff report to Council regarding the need to establish
charges for the ambulance services provided by the City. He stated that the Fire
Department is seeking to hire three full-time firefighter/paramedics. The hiring of career
personnel would improve response time. This would enable immediate response time 24
hours a day, 365 days a year. Currently the Fire Department is able to have a full-time
staff during the weekdays. An agency that specializes in the costs associated with this
service would collect from the insurance companies. Sherri Hardewig of Medicount
Management was present at the meeting. Mayor Gilman said that she had received a
letter expressing concern for the cost to senior citizens. Chief Keister said that anyone
with questions could call the department and they would address the issues. Mr. Jensen
said that he understood that Medicare and Medicaid should almost completely cover the
cost of the service. Chief Keister stated that the fees have been based in part on the
coverage from Medicare and Medicaid. Ms. Hardewig reiterated this and noted that
Medicare would pay 80% of the allowed amount and Medicaid payments would be
accepted as paid.
This is the First Reading of Ordinance No. 3085.
Ordinance No. 3083: An ordinance repealing Sections 150.01 through 150.09 of the Code
of Ordinances of West Carrollton and adopting new Sections 150.01 through 150.09, said
sections being entitled "Adoption of Building Codes".
A motion was made by Mr. Garrison and seconded by Mr. Sanner to dispense with the
second reading of Ordinance No. 3083. A roll call vote was taken: Mr. Gordon-yes, Mr.
Jensen-no, Mrs. Lotspaih-yes, Mr. Sanner-yes, Mayor Gilman-yes, Mr. Ennis-yes, Mr.
Garrison-yes. The motion carried. Mr. Garrison made a motion, seconded by Mr.
Gordon, to adopt Ordinance No. 3083. A unanimous roll call vote carried the motion.
Mr. Jensen noted that his no vote to the dispensing of the second reading was not an
indication of his opinion of the Ordinance but rather that he feels that the nature of the
Ordinance needs a second reading. Mr. Garrison stated that there are time restraints
involved which necessitate a more immediate decision.
Ordinance No. 3084: An ordinance amending Chapter 158, known as the Property
Maintenance Code of the City of West Carrollton, updating the definitions and regulations
thereof.
A motion was made by Mr. Garrison and seconded by Mr. Gordon to dispense with the
second reading of Ordinance No. 3084. A roll call vote was taken. With the exception of
Mr. Jensen who voted no, all other members voted yes and the motion carried.
Mr. Sanner made a motion, seconded by Mrs. Lotspaih, to adopt Ordinance No. 3084. A
unanimous roll call vote carried the motion.
Mr. Sanner noted that the rent on this property is usually $1.00 per year but there is some
curb work to be done which is estimated to cost $600.00. Therefore the rent for one year
will be $600.00. The Mayor asked if Mr. Carney had reviewed the agreement. Mr.
Carney stated that he had written and reviewed the agreement. Mr. Sanner made a
motion, seconded by Mr. Gordon, to authorize the City Manager to enter into a property
lease agreement with Grant Kirby for the use of the soccer fields at the L.G. Cook facility
(Alex Road and Liberty Lane). A unanimous roll call vote carried the motion.
Mr. Williams informed Council that he had received a request from Harold Schnell School
for a contribution to their Winter Carnival. He suggested ten one-day pool passes. A
motion was made by Mr. Ennis and seconded by Mr. Gordon to authorize the City
Manager to donate ten one-day pool passes to Harold Schnell for their Winter Carnival. A
unanimous roll call vote carried the motion.
Mr. Williams also informed Council that vehicle bids were held on February 6, 1998.
There were a total of four bids with the lowest bid being from White-Allen Chevrolet. The
accepted bid was $27,403.00 for a truck.
Mr. Williams noted that the next Citizens Academy will be on Monday, February 16th at
7:00 p.m. The focus will be on the West Carrollton School District. Dr. Roby and other
members of the school district will be there.
Betty Fiste of 25 West Main Street addressed Council. Mrs. Fiste wished to thank the
Fire Department and the EMTs for all of their care and concern for her husband, Bud,
who passed away on November 27, 1997 after a long illness. Mrs. Fiste said that her
husband liked to sit on the porch a lot and when the fire department drove by, they always
waved to him which always buoyed his spirits. She wished to thank Leanne Nash, Chief
Ennis and many others whose names she sometimes didn't even know. She especially
wished to thank Dave Kunke for his thoughtfulness and concern. Mrs. Fiste said she will
never forget the Fire Department and the EMTs for all they did for her and her husband
and she wished to thank them all. Mayor Gilman asked Chief Keister to pass the
message on to the Fire Department and EMTs.
John Griffin addressed Council with concerns over the truck traffic at Farmersville-West
Carrollton Road. He feels that when spring comes, the situation will be worse. Mayor
Gilman stated that there had been a meeting regarding this matter. She asked Mr. Griffin
to make a list of the areas he feels are of concern so that Mr. Williams and Mr. Hill can go
over each item.
Mr. Gordon reminded everyone that the Rotary Spaghetti Dinner will be on February 21st
at the Senior High School from 4:30 p.m. to 8:00 p.m.
Mr. Ennis expressed his condolences to Mrs. Fiste and thanked her for her comments.
Mr. Jensen noted that there is a vacancy on the Property Maintenance Appeals Board
and nominated Bill Thomas to fill the existing vacancy. Mr. Gordon seconded the motion.
All members voted Yes to a roll call vote and the motion carried.
Mr. Garrison commended the Street Department for the great job they did during the bad
weather days we recently experienced.
Mrs. Lotspaih encouraged everyone to attend the Citizens Academy. She also thanked
the Street crews for a fine job.
Mr. Sanner thanked the Street Department crew for their good work during the snow days
and for their prompt removal of a cat found in the street before area children saw it.
Mayor Gilman thanked Ron Ziemkowski on cameras. She also noted that she had
received a letter from Dr. Augustine praising the work of the West Carrollton EMTs and
Fire Department.
A motion was made by Mayor Gilman, seconded by Mr. Gordon, to recess to an executive
session to discuss a real estate matter and to a work session to discuss the items on the
agenda. A unanimous roll call vote carried the motion.
Council recessed to an executive session and to a work session.
EXECUTIVE SESSION
Joining City Council in the executive session were City Manager, Tracy Williams; Assistant
City Manager, David Rowlands; Service Director, Don Hill; and Planning and Economic
Development Director, David Humphreys
REAL ESTATE MATTERS
City Council discussed the acquisition of property.
Councilmember Jeff Sanner moved to reconvene into the regular work session.
Councilmember Bill Ennis seconded the motion. All members present voting Yes, the motion
carried.
WORK SESSION
VISION RETREAT
Mayor Gilman asked if City Council would like to have Mary Ellen Mazey facilitate the retreat
this year and asked for some suggested dates to hold the retreat.
Mr. Williams said he would contact Ms. Mazey and will schedule the retreat in late April or
early May.
CHANGE ORDERS
Mr. Williams informed council that they needed to establish guidelines for making change
orders. This recommendation came from the state auditors report.
City Council asked staff to prepare some guidelines for their review.
Councilmember Lotspaih mentioned that she would like to see economic development
properties on the city's Web site.
Mayor Gilman mentioned the Business Focus Lunch and asked which members of Council
would be attending.
Mayor Gilman mentioned the OML Legislative Luncheon and suggested that Council review
the Wilson Park Swimming Pool promotion plan at the next meeting.
ADJOURNMENT
Having no further business, Councilmember Bill Gordon moved to adjourn. Councilmember
Jensen seconded the motion. All members present voting Yes, the motion carried.
